A crucial part of the Data Factory is the expertise it can muster. Aside from cutting-edge infrastructure and compute power, every successful project relies on technical and legal know-how.

The Data Factory provides expertise on how to set up data factories as well as legal and strategic knowledge and frameworks. 

Legal Expert Group

The ongoing work with the Data Factory demonstrates a growing need for expertise in how to deal with the legal aspects of data sharing and model training. To meet this need AI Sweden set up a group of legal experts to explore challenging legal questions related to AI, data sharing and GDPR. 

The Legal Expert Group consists of a number of legal experts from our partners who discuss legal questions related to AI and data. They are collaborating in an effort to produce, for example, white papers, guidelines and/or common interpretations and solutions for legal issues that could benefit all partners within AI Sweden.

In the Privacy Protection Report 2020,  IMY (the Privacy Protection Authority) stated that data-driven innovation creates new services and functions that add value to society, the environment, companies and increased the quality of life for individuals. At the same time development inevitably means risks from one privacy protection perspective. 

In April 2021,  IMY was commissioned by the government to carry out knowledge-raising initiatives on privacy and data protection issues in the innovation system, both through external efforts and by developing IMY's ability to follow and analyze technological development and provide guidance and support.

IMY has been working on the assignment since August 2021 and completed a number of activities. The focus has been on mapping the legal needs of innovation actors linked to privacy and data protection, identifying key collaboration partners,
building up structured surveillance of the surrounding world, and beginning the work of carrying out external efforts. Examples of central activities have been workshops, round table discussions and interviews with innovation actors, a researcher hearing and
collaboration with individual researchers, and holding webinars on sustainable digitization and facial recognition.

IMY has made several experiences during the first phase of the mission. It is clear that the innovation actors feel that data sharing is the issue that causes the most legal challenges. The legal problems experienced in connection with data sharing are
many and complex. The innovation actors are demanding more guidance and clarity in legal positions from IMY. In-depth case-based training is also desired guidance. Finally, an important experience is that collaboration within and between
organizations is a success factor for working effectively with support for innovation actors.

During the mission's second phase (April 1, 2022 – March 31, 2023), IMY will be issued from the experiences and form measures accordingly. IMY shall implement knowledge development efforts related to innovation, for example producing guidance
about data sharing.  IMY will improve its guidance to innovation actors by, for example, building an innovation portal and conducting training for startup companies.

IMY will conduct a pilot case regarding regulatory testing activities. They must also strengthen cooperation within and between organizations, among other by building up a pool of innovation competence for continuous dialogue, learning and collaboration.
